We currently conduct Phase I Environmental Site Assessments (Phase I ESAs). Phase I ESAs constitute an All Appropriate Inquiry and as such are admissible innocent landowner defense. However, not finding any recognized environmental conditions (RECs) does not serve as a warranty or guarantee that the property is free from contamination.
